The ACT introduced a new licensing scheme for labour hire providers which is focused on encouraging responsible employment practices in the ACT. The scheme seeks to ensure that labour hire businesses operating in the ACT meet their workplace obligations and responsibilities to their workers.
The Bill is aimed at achieving this through a policy and management framework which effectively prevents non-compliance with workplace standards in the labour hire industry by:
- requiring labour hire operators to be licensed.
- providing disincentives for use of unlicensed labour hire operators (fines).
- includes a ‘suitable person’ test to determine suitability of business owners for licensing.
- requires licensees to demonstrate a history of, and ongoing compliance with, industry standards and workplace laws.
